§ 1 Scope
These General Terms and Rental Conditions apply to all contracts for the short-term rental of the “Chillach” holiday apartments, Klagenfurter Straße 43, 9500 Villach, Austria, between Monte Nivis GmbH, Hofbauerweg 21, 4213 Unterweitersdorf, Austria (the “Landlord”) and the guest (the “Guest”) concluded directly via this website or by email.
For bookings via Booking.com, Airbnb or other platforms, the terms of the respective platform take precedence.
§ 2 Enquiry and conclusion of contract
(1) An enquiry via the website is free of obligation and does not constitute a contract.
(2) In response to an enquiry, the Landlord sends an offer by email. The rental contract is concluded when the Guest accepts the offer and the Landlord confirms the booking by email (booking confirmation).
(3) The booking Guest must be of legal age and is responsible for compliance with the contract by all persons travelling with them.
§ 3 Services and occupancy
(1) The scope of services is set out in the description of the respective apartment on the website and in the booking confirmation. The rental price includes in particular bed linen, towels, Wi-Fi, electricity, water, heating and a private parking space behind the house.
(2) The apartment may be occupied by no more than the number of persons stated in the booking (Chillach 1: up to 7 persons, Chillach 2: up to 4 persons, Chillach 3: up to 7 persons). Additional occupancy requires the Landlord's prior consent and may be charged separately.
(3) The minimum stay is 2 nights.
(4) Subletting or making the apartment available to third parties is not permitted.
§ 4 Prices and additional costs
(1) All prices are in euros and include statutory VAT (currently 10% for accommodation).
(2) The final cleaning fee is already included in the price.
(3) In addition, the City of Villach tourist tax or the Carinthian visitor tax applies. It is charged per person per night at the statutory rates in force and shown separately in the quote.
(4) Additional services such as early arrival or late departure are charged as agreed.
§ 5 Payment
(1) A deposit of 30% of the total price is payable within 7 days of receipt of the booking confirmation.
(2) The balance is due no later than 14 days before arrival. For bookings made less than 14 days before arrival, the full amount is due immediately.
(3) Payment is made by bank transfer or online (e.g. by credit card). The available payment methods and payment details are stated in the booking confirmation.
(4) If a payment due is not received despite a reminder with a reasonable grace period, the Landlord may withdraw from the contract. In this case, the cancellation fees under § 6 apply.
§ 6 Cancellation by the Guest
(1) The Guest may withdraw from the contract at any time. Cancellation must be made in writing (by email); the date of receipt by the Landlord is decisive.
(2) The following fees are charged on the total price (excluding tourist or visitor tax) in the event of cancellation:
- up to 30 days before arrival: free of charge
- 29 to 14 days before arrival: 50%
- 13 to 3 days before arrival: 80%
- from 2 days before arrival or in case of no-show: 90%
(3) Payments already made will be credited. If the Landlord succeeds in re-letting the apartment for the cancelled period at the same price, only a handling fee of € 30.00 is charged.
(4) In case of late arrival or early departure, the agreed total price is payable.
§ 7 No statutory right of withdrawal
For contracts for accommodation on a specific date, there is no statutory right of withdrawal under § 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG). The cancellation terms under § 6 apply.
§ 8 Withdrawal by the Landlord
(1) The Landlord may withdraw from the contract if the deposit or balance is not paid on time (§ 5(4)).
(2) If the apartment cannot be provided for reasons beyond the Landlord's control (e.g. force majeure, water damage), the Landlord will endeavour to find equivalent alternative accommodation. If this is not possible, all payments made will be refunded in full. There are no further claims.
(3) In the event of serious breach of contract, in particular overcrowding, parties or significant disturbance of neighbours, the Landlord may terminate the contract with immediate effect. In this case, the rental price will not be refunded.
§ 9 Arrival and departure
(1) In all apartments, check-in is from 2 pm and check-out is by 11 am.
(2) Access is via self check-in with a personal PIN code. The Guest receives the code and directions (including access to the parking space) by email once full payment has been received.
(3) Early arrival or late departure is possible subject to availability and prior agreement. If the apartment is not vacated on time without agreement, an additional night may be charged.
§ 10 House rules and Guest obligations
(1) The Guest undertakes to treat the apartment and its furnishings with care and to observe the house rules.
- Smoking is not permitted anywhere in the apartment.
- Pets are not allowed.
- Parties, events and stag or hen parties are not permitted.
- Quiet hours from 10 pm to 7 am; please be considerate of the neighbours.
- Waste must be separated and disposed of in the bins provided.
- Please close the windows and switch off appliances when leaving the apartment.
- The parking space may only be used for one vehicle belonging to guests of the booked apartment.
(2) Any damage or defects must be reported to the Landlord immediately so that they can be remedied. Failure to report may limit the Guest's later claims.
§ 11 Liability and damage
(1) The Guest is liable for damage culpably caused by them or the persons travelling with them. The Landlord is entitled to charge for such damage in the proven amount, including after departure. No security deposit is collected.
(2) The Landlord is not liable for damage caused by slight negligence, except for personal injury. The Landlord is only liable for valuables brought along and parked vehicles in the event of intent or gross negligence.
(3) Short-term outages of Wi-Fi, TV or other appliances for which the Landlord is not responsible do not entitle the Guest to a price reduction, to the extent permitted by law.
§ 12 Registration and data protection
(1) Under the Austrian Registration Act (Meldegesetz), guests are required to provide the data required for the guest register (including name, date of birth, nationality and home address) before or on arrival.
(2) Personal data is processed in accordance with the privacy policy on this website.
§ 13 Final provisions
(1) Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the Guest's country of residence remain unaffected.
(2) For claims against consumers, § 14 of the Austrian Consumer Protection Act applies. For businesses, the competent court at the Landlord's registered office has jurisdiction.
(3) Amendments and additions to the contract must be made in writing; email is sufficient.
(4) Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
